1. Agreement to Terms

By accessing or using Dipsern at dipsern.com ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

Dipsern is a quantitative analysis tool that identifies buying opportunities during market drawdowns using probabilistic analysis. The Service provides statistical insights, historical data analysis, portfolio backtesting, and asset ranking across multiple categories including stocks, ETFs, crypto, commodities, forex, and CS2 cases.

Dipsern is a decision-support tool. It does NOT execute trades, manage portfolios, or provide personalized investment advice.

4. Account Terms

• You must be at least 18 years old to use the Service.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete information when creating your account.
• One account per person. Sharing account credentials with others is prohibited.
• We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscription Terms

Dipsern offers three tiers:

• Free — 5 analyses per month, no credit card required.
• Pro ($79/month or $790/year) — Unlimited analyses, asset ranking, portfolio backtesting, CSV exports.
• Premium ($299/month or $2,990/year) — Everything in Pro, plus REST API access, custom parameters, and priority support.

Paid subscriptions are billed in advance on a monthly or annual basis. Subscriptions auto-renew at the end of each billing period unless cancelled. All payments are processed securely by Stripe.

6. Cancellation & Refund Policy

• You may cancel your subscription at any time through the billing settings in your dashboard.
• Upon cancellation, you retain access to paid features until the end of your current billing period.
• 14-day money-back guarantee — if you are unsatisfied with a paid plan, request a full refund within 14 days of your initial purchase or most recent renewal.
• Refund requests after 14 days are handled on a case-by-case basis at our discretion.

7. Acceptable Use

You agree not to:

• Reverse-engineer, scrape, or systematically extract data from the Service beyond normal use or authorized API access.
• Resell, redistribute, or sublicense Dipsern data or analysis results to third parties without written permission.
• Use the Service to violate any applicable law or regulation.
• Attempt to circumvent rate limits, authentication, or access controls.
• Interfere with or disrupt the Service or its infrastructure.
• Share API keys with unauthorized users (Premium tier).

8. API Access (Premium Tier)

Premium subscribers may access the Dipsern REST API with up to 5 API keys. API keys are personal and non-transferable. We reserve the right to revoke API access for abuse, excessive load, or violations of these terms. API rate limits and fair-use policies apply.

9. Intellectual Property

The Dipsern algorithm, software, design, content, and documentation are the intellectual property of Dipsern. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes. You may not copy, modify, or distribute our proprietary technology.

10. Data Accuracy

We source market data from Yahoo Finance, CoinGecko, and the Steam Community Market. While we strive for accuracy, we do not guarantee that all data is complete, up-to-date, or error-free. Data gaps, exchange outages, or provider issues may temporarily affect analysis results. You should not rely solely on Dipsern data for financial decisions.

11. Limitation of Liability

To the maximum extent permitted by law, Dipsern and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, losses from investment decisions made using Dipsern analysis, data inaccuracies, service interruptions, or unauthorized access to your account.

Our total liability for any claim arising from these terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that analysis results will be accurate or profitable.

13. Indemnification

You agree to indemnify and hold harmless Dipsern and its operators from any claims, losses, or damages arising from your use of the Service, your violation of these terms, or your investment decisions.

14. Modifications to Terms

We may update these Terms of Service at any time. Material changes will be communicated via email or a notice on the website. Your continued use of the Service after changes constitutes acceptance of the updated terms.

15. Governing Law

These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation or, if necessary, binding arbitration.
